Terms & Conditions for Shipt Gift Cards

The following Shipt’s Terms and Conditions for Gift Cards (“Agreement”) describe the terms and conditions that apply to use of Shipt’s general use gift cards and membership gift card (collectively, “Gift Card(s)”). This Agreement is by and between Shipt, Inc. and the purchaser, recipient or redeemer of Gift Cards (“you”). By purchasing, accepting or using a Gift Card, you agree to be bound by this Agreement. If you do not agree with this Agreement, do not purchase, use or accept any Gift Card.

The terms and conditions of the Shipt Terms at www.shipt.com/legal/terms-of-service (“Terms”), are incorporated herein by reference. Please be advised this Agreement contains an arbitration agreement section entitled “Arbitration Agreement,” which will require you to submit claims you have against us to binding and final arbitration.

Types of Cards. Gift Cards are currency-denominated cards that contain a value or balance (e.g., $100) that is redeemable for eligible goods and services on Shipt’s web site, on “Storefront” sites, or through Shipt’s mobile app (“Shipt Site(s)”). Eligible goods and services are subject to change in our sole discretion. Gift Cards are one-time use cards and are only redeemable on a Shipt Site.

Issuance of Cards. You can purchase Gift Cards with, or without, a Shipt account. However, you must have a Shipt account to redeem Gift Cards. Shipt is the Gift Card issuer and sole obligor to you. Shipt may delegate its issuer obligations to an assignee, without recourse. If delegated, the assignee, and not Shipt, will be the sole obligor to you.

Limitations. To the extent permitted by law, Gift Cards cannot be reloaded, used for payment outside of Shipt Sites, used for unauthorized advertising, marketing, sweepstakes, promotional or commercial purposes, redeemed for more than face value, transferred for value, or returned for a cash refund (except to the extent required by law). Unused Gift Card balances in a Shipt account may not be transferred to another Shipt account. Gift Cards are not refundable and cannot be redeemed for cash, resold and have no cash value, except as required by law. The entire value of the Gift Card will be applied to your Shipt account in the form of credits upon redemption. Shipt may limit the amount and number of Gift Cards you are permitted to purchase in one transaction. Your Gift Card cannot be used to purchase other Gift Cards, prepaid open loop cards, or certain third-party gift cards, if available. The Gift Card is not redeemable outside of areas where Shipt services are available.

How to Redeem Your Gift Card. To redeem your Gift Card, please visit https://www.shipt.com/shop/account/wallet . In order to redeem or use your Gift Card you must have an Shipt account.

Expiration/Deactivation; Fees. Gift Cards do not expire, are applied to eligible purchases despite any stated expiration date, and no inactivity fees or service fees apply. A Gift Card’s load value never expires.

Use of Gift Cards. You may be required to add a secondary payment method to use Gift Cards on Shipt Sites. Gift Cards will be set as your default payment method. If you wish to use another payment method you may change your payment method on the Shipt Site. To view your Gift Card balance, visit your dashboard after signing into your Shipt account. You agree not to use the Gift Card in any unlawful manner or in a manner that is otherwise misleading, deceptive, unfair or harmful to Shipt or any other third party. You agree that we may, without notice to you, deactivate, cancel or suspend your Gift Card (without a refund, to the extent permitted by law) if we suspect fraud, unlawful activity or improper Gift Card use or that you violated the terms of this Agreement. You acknowledge that we reserve the right to correct the Gift Card balance if we believe that a clerical, billing or accounting error has occurred.

Risk of Loss. Title to Gift Cards and the risk of loss, destruction or deterioration pass to you upon purchase. You are responsible for safeguarding your Gift Card. Shipt is not responsible for any Gift Cards that are lost, stolen, destroyed or used without your permission.

Lost, Stolen, or Unauthorized Use of Gift Cards. Shipt is not responsible for any loss or damage resulting from lost, stolen, or fraudulently obtained Gift Cards or unauthorized or unlawful use of Gift Cards. Shipt reserves the right to refuse to honor a Gift Card where Shipt suspects that the Gift Card was obtained fraudulently.

Entire Agreement. This Agreement, including the Terms, constitutes the entire agreement concerning your Gift Card.

Governing Law / Jurisdiction. This Agreement (including any non-contractual disputes/claims arising out of or in connection with this Agreement) is governed by and subject to the laws of the State of Delaware without regard to choice or conflicts of law principles.

Arbitration Agreement. Any dispute or claim relating in any way to Gift Cards will be resolved in accordance with Section 12 (Disputes & Arbitration) of the Terms.

Changes to this Agreement and Assignment. Shipt reserves the right to change this Agreement from time to time, in its discretion, which Shipt may provide to you by any reasonable means, including without limitation, by posting the revised version of this Agreement on a Shipt Site. The most current Agreement shall be available at (insert link to the LP these terms will live on), and will supersede all previous versions of the Agreement. The most current Agreement shall be effective upon Shipt’s posting of such modified Agreement. Your use of any portion of any Gift Card after such posting constitutes your acceptance of the modified Agreement. We may assign this Agreement at any time without notice to you.

Limitation of Liability. TO THE FULL EXTENT PERMISSIBLE BY LAW, SHIPT AND ITS AFFILIATES MAKE NO WARRANTIES, WITH RESPECT TO GIFT CARDS INCLUDING, WITHOUT LIMITATION, ANY SHIPT MEMBERSHIP OR IMPLIED WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT THAT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OR CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU.

Terms & Conditions for Shipt Membership Gift Cards

The following Terms and Conditions for Shipt Membership Gift Cards (“Agreement”) describe the terms and conditions that apply to use of Shipt Membership gift cards. This Agreement is by and between Shipt, Inc. and the purchaser, recipient or redeemer of Gift Cards (“you”). By purchasing, accepting or using a Gift Card, you agree to be bound by this Agreement. If you do not agree with this Agreement, do not purchase, use or accept any Gift Card.

Please be advised that this Agreement contains an arbitration agreement section entitled “Arbitration Agreement,” which will require you to submit claims you have against us to binding and final arbitration.

1. Types of Cards. Shipt’s membership program waives the delivery fee and reduces certain service fees for scheduled deliveries on orders of $35 or more with each retailer placed through Shipt Sites (as defined herein) for a monthly or yearly subscription fee. Gift Cards are one-time use cards and are only redeemable on Shipt’s website or through Shipt’s mobile app (“Shipt Site(s)”) for Shipt memberships. You can purchase an Shipt membership Gift Card in the following increments:

Shipt members with a current membership can not redeem Shipt Membership Gift Cards. Customers who redeem their Shipt Membership Gift Card need to create a Shipt account to redeem their membership for the applicable 6-month, or annual term.

2. Issuance of Cards. You can purchase Gift Cards with, or without, a Shipt account. However, you must have a Shipt account to redeem Gift Cards.

3. Limitations. To the extent permitted by law, Gift Cards cannot be reloaded, used for anything other than a Shipt membership, used for unauthorized purposes, redeemed for more than face value, transferred for value, or returned for a cash refund (except to the extent required by law). Gift Cards are not refundable and cannot be redeemed for cash, resold and have no cash value, except as required by law. The entire value of the Gift Card will be applied to your Shipt account upon redemption. You can buy up to 10 individual Gift Cards per order. Your Gift Card cannot be used to purchase other Gift Cards, prepaid open loop cards, or certain third-party gift cards. The Gift Card is not redeemable outside of areas where Shipt membership services are available.

5. Expiration/Deactivation; Fees. Gift Cards do not expire and applied to eligible purchases despite any stated expiration date, and no inactivity fees or service fees apply. A Gift Card’s load value never expires; should Shipt discontinue the Shipt membership program the Gift Card’s load value may be redeemed for its value on Shipt Sites.

6. Use of Gift Cards. You agree not to use the Gift Card in any unlawful manner or in a manner that is otherwise misleading, deceptive, unfair or harmful to Shipt or any other third party. You agree that we may, without notice to you, deactivate, cancel or suspend your Gift Card (without a refund, to the extent permitted by law) if we suspect fraud, unlawful activity or improper Gift Card use or that you violated the terms of this Agreement. You acknowledge that we reserve the right to correct the Gift Card balance if we believe that a clerical, billing or accounting error has occurred.

7. Risk of Loss. Title to Gift Cards and the risk of loss, destruction or deterioration pass to you upon purchase. You are responsible for safeguarding your Gift Card. Shipt is not responsible for any Gift Cards that are lost, stolen, destroyed or used without your permission. Shipt is not responsible for any loss or damage resulting from lost, stolen, or fraudulently obtained Gift Cards or unauthorized or unlawful use of Gift Cards. Shipt reserves the right to refuse to honor a Gift Card where Shipt suspects that the Gift Card was obtained fraudulently.

9. Promotional Cards. Shipt may also issue promotional gift cards and gift codes (“Promotional Cards”). Promotional Cards are not subject to this Agreement, may be issued or distributed by Shipt and may be subject to an expiration date and other conditions, as specified on the Promotional Cards or in related promotional materials.

11. Governing Law / Jurisdiction. This Agreement (including any non-contractual disputes/claims arising out of or in connection with this Agreement) is governed by and subject to the laws of the State of Delaware without regard to choice or conflicts of law principles.

12. Arbitration Agreement. Any dispute or claim relating in any way to Gift Cards will be resolved in accordance with Section 12 (Disputes & Arbitration) of the Terms.

13. Changes to this Agreement and Assignment. Shipt reserves the right to change this Agreement from time to time,. in its discretion, which changes Shipt may provide to you by any reasonable means, including without limitation, by posting the revised version of this Agreement on a Shipt Site. The most current Agreement shall be available at https://www.shipt.com/shop/account/wallet , and will supersede all previous versions of the Agreement. The most current Agreement shall be effective upon Shipt’s posting of such modified Agreement. Your use of any portion of any Gift Card after such posting constitutes your acceptance of the modified Agreement. We may assign this Agreement at any time without notice to you.

14. Limitation of Liability. TO THE FULL EXTENT PERMISSIBLE BY LAW, SHIPT AND ITS AFFILIATES MAKE NO WARRANTIES, WITH RESPECT TO GIFT CARDS INCLUDING, WITHOUT LIMITATION, ANY SHIPT MEMBERSHIP OR IMPLIED WARRANTY OR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT THAT A GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND OUR SOLE LIABILITY, SHALL BE THE REPLACEMENT OF SUCH GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OR CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU.
